ONLINE STORE TERMS AND CONDITIONS

§ 1. GENERAL PROVISIONS

  1. These Terms and Conditions define the rules for using the online store available at www.animaart.shop

  4. The online store specializes in the sale of art, artistic crafts, and mirrors.

§ 2. DEFINITIONS

  1. Seller

    • Anima & Art Sp. z o.o.
  2. Customer

    • a natural person, legal entity, or organizational unit without legal personality that makes purchases in the Store.
  3. Consumer

    • a natural person making a purchase not directly related to their business or professional activity.
  4. Store

    • the online store operated by the Seller at www.animaart.shop
  5. Sales contract

    • a contract for the sale of a Product concluded between the Customer and the Seller through the Store.

§ 3. CONDITIONS FOR CONCLUDING A SALES CONTRACT

  1. Placing an order by the Customer constitutes an offer to conclude a sales contract.
  2. The sales contract is concluded upon the Customer receiving confirmation of order acceptance for processing.
  3. Acceptance of these Terms and Conditions is a prerequisite for placing an order.
  4. Product prices are given in Polish zloty (PLN) and include VAT.

§ 4. PLACING ORDERS

  1. Orders can be placed 24 hours a day, 7 days a week through the Store's website.

  2. To place an order, you must:

    • Select products and add them to the cart
    • Provide data necessary for order fulfillment
    • Choose delivery and payment method
    • Accept the Terms and Conditions
    • Confirm the order
  3. After placing an order, the Customer will receive confirmation at the provided email address.

§ 5. PAYMENTS

  1. The Store offers the following payment methods:

    • Electronic payments (Shopify Payments)
    • Traditional bank transfer
    • Other available payment methods indicated in the Store
  2. The Customer is obliged to make payment within 7 days from the date of concluding the sales contract.

§ 6. DELIVERY

  1. Products are delivered within Poland and abroad, in accordance with the options available in the Store.
  2. Order processing time is from 1 to 14 business days, unless a different deadline is specified in the product description or during order placement.
  3. Delivery costs are indicated during order placement and depend on the chosen delivery method.

§ 7. RIGHT OF WITHDRAWAL

  1. The Consumer has the right to withdraw from the contract without giving a reason within 30 days from the date of receiving the goods.

  2. To exercise the right of withdrawal, the Customer should inform the Seller:

  3. Return address: Drwęcka 1A/5, 87-400 Golub-Dobrzyń, Poland

  4. The goods must be returned within 14 days from the date of submitting the withdrawal statement.

  5. Return shipping is free of charge. The Seller covers the return shipping costs by providing a free return label or arranging for the collection of the parcel at our expense.

    • The Seller covers the return shipping costs.
  6. The Seller will refund all payments received immediately, no later than within 14 days from receiving the Customer's withdrawal statement.

§ 8. COMPLAINTS

  1. The Seller is liable to the Customer under warranty for physical and legal defects of the goods in accordance with applicable law.

  2. Complaints can be submitted:

  3. The complaint should include:

    • Description of the defect or non-conformity
    • Customer's request (repair, replacement, price reduction, withdrawal from contract)
    • Contact details
    • Order number
  4. The Seller will process the complaint within 7 business days from the date of receipt.

  5. The response to the complaint will be sent to the email or postal address provided in the complaint submission.

  6. 6. If the complaint is accepted, the defective goods should be returned to: Drwęcka 1A/5, 87-400 Golub-Dobrzyń, Poland. Return shipping is free of charge. The Seller covers the return shipping costs by providing a free return label or arranging for the collection of the parcel at our expense.

§ 8A. WARRANTY

  1. The Seller grants a 5-year warranty on mirrors sold in the Store, calculated from the date of purchase.

  2. The warranty covers manufacturing defects only, in particular:

    • Power supply damage
    • LED (lighting) damage
    • Switch damage
  3. The warranty does not cover:

    • Mechanical damage (cracks, scratches)
    • Damage resulting from improper use
    • Damage resulting from improper installation
    • Normal wear and tear
    • Damage resulting from force majeure
  4. In case of a defect covered by the warranty, the Customer should contact the Seller:

  5. Products covered by warranty should be returned to: Drwęcka 1A/5, 87-400 Golub-Dobrzyń, Poland

  6. The Seller covers the costs of returning the product under warranty.

  7. The warranty does not exclude, limit, or suspend the Customer's rights under statutory warranty.

§ 9. PERSONAL DATA PROTECTION

  1. The controller of Customers' personal data is Anima & Art Sp. z o.o.
  2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
  3. Detailed information regarding the processing of personal data can be found in the Privacy Policy.

§ 10. OUT-OF-COURT COMPLAINT RESOLUTION

  1. The Consumer has the option to use out-of-court methods of complaint resolution and pursuing claims.
  2. The Consumer may file a complaint through the EU online ODR platform available at: http://ec.europa.eu/consumers/odr/

§ 11. FINAL PROVISIONS

  1. The Seller reserves the right to make changes to the Terms and Conditions.
  2. Orders placed before the changes take effect are processed based on the Terms and Conditions in force on the date the order was placed.

  3. In matters not regulated in these Terms and Conditions, the provisions of Polish law apply, in particular:

    • Civil Code
    • Consumer Rights Act
    • Act on the provision of electronic services
  4. These Terms and Conditions enter into force on the date of publication in the online Store.
